1. HOW TO ENTER: To enter, complete and submit the Win Electrophoresis survey.
Each participant shall automatically earn one (1) entry into the drawing upon completion and submission of the Survey. Only one (1) entry per person may be earned by completing and submitting the Survey during the Entry Period. Any attempt by any participant to obtain more than the stated number of entries by completing and submitting multiple Surveys using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant's entries and that participant may be disqualified
Each entrant represents that he/she is the sole author of the survey and that information submitted is correct to the best of the author's knowledge. Incomplete, false, fraudulent, deceptive and/or illegible submissions are void and shall render the entrant ineligible for the Sweepstakes. Sponsor assumes no responsibility for lost, late, or misdirected entries or for any computer, online, telephone, or human error or technical malfunctions that may occur.
By following the instructions on-line, each entrant may refer friends to enter the Sweepstakes during the Entry Period. For each friend you refer who completes and submits the Survey for the first time as a result of the referral, you will receive one (1) additional entry into the Sweepstakes. You can refer as many friends as you wish. To refer a friend, you must have an existing personal relationship with the referred friend and believe that he/she would be interested in learning about and participating in the Sweepstakes.
To enter without completing the survey, please send a self-addressed, stamped envelope to: Electrophoresis Giveaway, Bio-Rad Laboratories, Inc., c/o NASD North America Marketing, 255 Linus Pauling Drive, Hercules, CA 94547, no later than 12/31/11.
All entry forms, including the Survey, become the property of Sponsor and will not be returned.
2. Entry Period/Eligibility: Electrophoresis Giveaway ("Sweepstakes") begins at 8:00 AM (EST) on 10/03/11, and ends at 6:00 PM (EST) on 12/31/11 ("Entry Period"). Entries submitted prior to or received after the Entry Period will not be eligible.
Sweepstakes is open to legal residents of the United States, excluding New York, Florida, Rhode Island and U.S. territories and possessions (except Puerto Rico), who are at least 18 years of age at the time of application.
Officers, directors, and employees of Bio-Rad Laboratories, Inc. ("Sponsor"), its affiliates, subsidiaries, participating vendors, distributors, sales representatives, and advertising and promotional agencies and the immediate family members and those living in the same household of each are not eligible to enter or win.
3. PRIZE: One (1) Grand Prize will be awarded and will include: one (1) ChemiDoc™ MP Imaging System, one (1) Trans-Blot® Turbo™ System, three hundred (300) Trans-Blot® Turbo™ transfer packs, three hundred (300) Mini-PROTEAN® TGX™ Stain-Free precast gels, one (1) Mini-PROTEAN® Tetra cell, ten (10) Protein standards, four (4) Immun-Star™ WesternC™ chemiluminescence kits, one (1) PowerPac™ Basic Power Supply, fifteen (15) bottles of 10X Tris/Glycine/SDS Running Buffer and three (3) bottles Laemmli Sample Buffer. Approximate retail value: $47,962.
Three (3) Second Prizes will be awarded and each Second Prize will include: three hundred (300) Mini-PROTEAN® TGX™ Precast gels, three hundred (300) Trans-Blot® Turbo™ transfer packs, ten (10) protein standards, one (1) Trans-Blot® Turbo™ system, one (1) Mini-PROTEAN® Tetra cell, four (4) Immun-Star™ WesternC™ chemiluminescence kits, one (1) PowerPac™ Basic Power Supply, fifteen (15) bottles of 10X Tris/Glycine/SDS Running Buffer and three (3) bottles Laemmli Sample Buffer. Approximate retail value for each second prize package: $18,608.
Fifty (50) Third Prizes will be awarded and each Third Prize will include: one (1) T-Shirt. Approximate retail value for each third prize: $10.
Sponsor will deliver the prize to the winner's designated address at Sponsor's expense and by method of Sponsor's choice (prizes will not be delivered to P.O. boxes). Each winner assumes responsibility for all other charges, if any. Any applicable tax on the prize is the sole responsibility of the winner. Certain restrictions may apply. No substitution, barter, cash redemptions, transfer, or assignment of any prize permitted by the winner. Sponsor reserves the right to substitute a prize of equal or lesser value if prize is unavailable.
4. WINNER SELECTION: One (1) Grand Prize winner, three (3) Second Prize winners and fifty (50) Third Prize winners will be selected in a random drawing from among all qualified entries, on or about February 1, 2012. The drawing will be conducted by Sponsor, the judges of this Sweepstakes, whose decisions are final on all matters relating to this Sweepstakes. The Sponsor will notify the winners by email or mail within ten (10) days of the drawing. If the winner does not respond within fourteen (14) days after Sponsor's first attempt to contact him/her or the prize notification is returned to Sponsor as undeliverable, the Sponsor may, at Sponsor's sole discretion, disqualify the winner. and select an alternate winner in his/her place at random from all other eligible entries received.
In the event that a winner is disqualified for the prize is forfeited for any reason, Sponsor will select an alternate winner by drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the applicable prize will remain un-awarded.
Odds of winning depend on the number of eligible entries received.
5. REQUIREMENT OF WINNERS: Except where prohibited by law, the winner may be required to compete and return an affidavit of eligibility and liability/publicity release (the "Affidavit/Release") within fourteen (14) days of being notified. Noncompliance by or failure of the winner to sign and return the Affidavit/Release within the required time period may result in disqualification and selection of an alternate winner by random drawing from all other eligible entries receive at Sponsor's sole discretion.
6. PUBLICITY: Except where prohibited by law, participating in the Sweepstakes constitutes winner's consent to the Sponsor's use of winner's name, voice, likeness and/or city/state of residence for the purpose of advertising, trade or promotion, in any media through the world, without further payment or consideration. Winner shall provide to Sponsor any and all information and/or documents necessary to find sufficient consent to such use of the winner's name, photograph, likeness, and/or city/state of residence.
7. PRIVACY: By participating in the Sweepstakes, you, the entrant, hereby authorize Sponsor the right to collect, use, process, transfer and store all data provided by you, including without limitation, personal data, to the United States, or any location throughout the world that the Sponsor deems appropriate to administer the Sweepstakes in accordance with these Official Rules, for example, to notify winners and to determine eligibility to enter the Sweepstakes. In addition, unless otherwise requested by the entrant and except where prohibited by law, Sponsor may use any or all personal information collected in connection with the Sweepstakes for direct marketing purposes of Sponsor, for example, to market products and services of the Sponsor. From time to time, Sponsor may contact Sweepstakes entrants with information and offers that Sponsor believes will be of interest to the entrant.
Sponsor may share personal information collected in connection with the Sweepstakes with third parties to the extent required to administer the Sweepstakes. Sponsor may share or transfer personal information in its database to a third party in other circumstances, such as in compliance with legal obligations.
8. GENERAL CONDITIONS: All details and other restrictions of Sweepstakes award not specified in these Official Rules will be determined by Sponsor in its sole discretion.
9. RELEASE AND LIMITATIONS OF LIABILITY: The Sponsor assumes no responsibility for any damage to an entrant's computer system which is occasioned by accessing the Website or otherwise participating in the Sweepstakes, or for any computer system, phone line, hardware, software or program malfunctions or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Entrant agrees to release and hold harmless Sponsor and its respective subsidiaries, affiliates, directors, officers, prize suppliers, employee and agents from any and all liability or any injuries, loss or damage of any kind arising from or in connection with this Sweepstakes and/or with respect to awarding, receipt, possession, use and/or misuse of any prize, or to participation in the Sweepstakes or in prize-related activities.
Without limiting the generality of the foregoing, Sponsoring Entity, to the extent permitted by law, is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or (if applicable) postage-due entry submissions or award notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, web sites, or other connections; or for miscommunications, failed, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in the entry submission or announcement of the award or in any award notification documents, or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information.
If, for any reason, the Sweepstakes is not capable of running as planned, including, due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right in its sole discretion to cancel, terminate, modify, suspend or extend the Sweepstakes and, in the event of any termination or cancellation, select a winner from among all eligible, non-suspect entries received prior to the termination or cancellation. Only the type and quantity of award described in these Official Rules will be awarded. If any provisions of these Official Rules are determined to be invalid or unenforceable, these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or unenforceable provision were not contained herein.
Sponsor reserves the right in its sole discretion to disqualify any individual if it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules. Any attempts by any person to deliberately damage any website or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.
10. DISPUTES: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION, AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE PROGRAM SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF CALIFORNIA, U.S.A., WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE'S LAWS. As a condition of participating in this Sweepstakes, each participant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Sweepstakes shall be resolved individually, without resort to any form of class action, exclusively before a court located in the State of California, U.S.A., having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives, all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with entering this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.
In the event that a dispute arises as to the identity of an entrant, the entries will be declared to have been made by authorized account holder of the email address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Potential winner may be required to provide proof showing that the entrant is the authorized account holder.
11. WINNERS LIST: For the names of winners, available after February 29, 2012, send a self addressed stamped envelope to Electrophoresis Giveaway, Bio-Rad Laboratories, Inc., c/o NASD North America Marketing, 255 Linus Pauling Drive, Hercules, CA 94547, no later than 12/31/11.
